This action arises out of a contract obligating Sid Grinker Company, Inc. (hereinafter referred to as Grinker) to renovate and repair portions of a building owned by Charles O. Craighead and Marie E. Craighead (hereinafter referred to as the Craigheads). The Craigheads refused to pay the sum specified in the contract, and Grinker sued to foreclose the lien given by sec. 289.01, Stats. The court impaneled a jury to resolve certain questions of fact, but the trial Judge determined, inasmuch as this was an equitable action, that the verdict was advisory only. The plaintiff alleged there was $1,200 due on the contract. The defendants counterclaimed for damages in excess of $3,400. The trial Judge found that, though the plaintiff did not perform the contract in accordance with the specifications or in a workmanlike manner, the defendants accepted the benefits from some of the work done by the plaintiff and that the value of the work so accepted totaled $835. The court also found some damage to the defendants as the result of improper work done by the plaintiff. The trial Judge found that the defendants were entitled to $15 for failure to haul away debris, $150 for improper installation of the aluminum trim, and $200 for improper installation of the front door. The court granted judgment to the plaintiff in the sum of $470, together with costs and disbursements. The defendants have appealed.
